These terms govern your use of steampunk.au (the "Site" or "Marketplace"), operated by Digital Education Systems (ABN 46 685 560 963) ("we", "us", "our"). By using the Site, creating an account, listing items, or making a purchase, you agree to these terms. If you don't agree, please don't use the Site.
STEAMPUNK.AU is an online marketplace and directory that connects independent Australian makers, artists and traders ("Sellers") with customers ("Buyers"). We provide the platform; we are not the seller of the goods listed by Sellers. Sellers are independent and solely responsible for their own products, descriptions, pricing, fulfilment and customer service.
If you apply to sell on the Site:
Fees are shown before you commit to them and are payable in Australian dollars. Payments are processed by third-party providers (Stripe and PayPal); your use of those services is also subject to their terms. We don't store your full card details.
Except where required by the Australian Consumer Law, the setup fee is non-refundable once work on your shop has begun. Subscriptions can be cancelled at any time and will stop at the end of the current paid period; part-periods are not refunded. (Please confirm this matches your intended policy.)
When you buy from a maker shop, your contract of sale is with that Seller, not with us. For casual listings, you arrange the purchase directly with the Seller. Returns, refunds and warranties are handled by the Seller, subject to your rights under the Australian Consumer Law.
Anyone may submit a festival or event to our directory. Submissions are moderated and we may edit, decline or remove them. By submitting, you confirm the information is accurate and that you have the right to share any images or video links provided, and you grant us a licence to display that content.
The Site, its branding, design and content (other than Seller and user content) are owned by us or our licensors and may not be copied or reused without permission. You retain ownership of content you upload, and grant us the licence described above to display it.
You agree not to misuse the Site, including by posting unlawful, infringing, misleading or harmful content, attempting to interfere with the Site's operation or security, or using it to send spam.
The Site is provided on an "as is" basis. We don't guarantee that listings, Sellers or products meet your expectations, and we're not responsible for transactions between Buyers and Sellers. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. To the extent permitted by law, our liability is limited, and we are not liable for indirect or consequential loss.
We may suspend or close accounts, or remove shops or listings, that breach these terms or that we reasonably consider harmful to the Marketplace or its users.

We may update these terms from time to time. Material changes will be reflected by the "last updated" date above, and continued use of the Site means you accept the updated terms.
These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that jurisdiction.
